Terms of Service

1. Acceptance of These Terms

These Terms of Service (the "Terms") govern your use of the Garmentz mobile application and the garmentz.app website (together, the "Service"). By creating an account or using the Service, you agree to these Terms. The Garmentz Privacy Policy explains how information is collected and used.

If you do not accept these Terms, do not use the Service. You may stop at any time, and you may delete your account in Settings.

2. About Garmentz

Garmentz helps you understand fashion items you own. You photograph or upload an item, such as a garment, footwear, a handbag, a small leather good, or an accessory, and the Service works to identify it, assess its visible condition, and estimate its resale value from market evidence.

You can save items to a collection, track value over time, create share cards on your device, keep a watch list, and browse market references in Explore. The Service may ask for additional photos, such as a label, interior, or outsole, to improve identity, condition, or price accuracy. Estimates can update when new market evidence becomes available.

Garmentz does not sell items, process payments, or connect buyers and sellers. There are no social features between users.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, a parent or legal guardian must review and accept these Terms on your behalf.

By using the Service, you confirm that you meet this requirement.

4. Accounts and Authentication

You sign in with an Apple, Google, or Microsoft account through our authentication provider, Supabase. Any valid account from one of those providers can be used; access is not restricted by email domain. Garmentz does not offer email and password sign-in, and there are no anonymous accounts.

The provider shares basic identity information with Garmentz when you sign in, as described in the Privacy Policy.

5. Account Security

Your session is stored on your device in the operating system's secure storage. You are responsible for activity under your account and for keeping the device you sign in on protected.

If you believe your account has been used without authorization, contact support@garmentz.app.

6. Supported Fashion Items

Garmentz is intended for supported fashion pieces, including apparel, footwear, handbags, small leather goods, jewelry or fashion accessories when supported, and similar garments and fashion pieces.

It is not intended to identify or appraise unrelated property such as cars, real estate, electronics, machinery, weapons, or unrelated collectibles. The Service may reject content outside its supported fashion domain.

7. User Content and Uploaded Photos

You retain ownership of the photos and other content you upload to the Service ("User Content"). Nothing in these Terms transfers ownership of your User Content to Garmentz.

You are responsible for your User Content. Upload only content you have the right to use.

8. License to Process User Content

You grant Garmentz a non-exclusive, worldwide, royalty-free license to host, store, transmit, and process your User Content only as needed to operate, secure, improve, and provide the Service. This includes sending photos you upload to the AI processing providers described in the Privacy Policy.

This license ends when your User Content is deleted, subject to the limited retention described in the Privacy Policy, for example where retention is required for security, fraud prevention, or legal obligations.

9. Fashion Identification and Condition Analysis

The Service uses automated systems to identify the likely item in your photos, its attributes such as brand, model, category, material, and color, and its visible condition.

Results depend on what is visible in your photos. Identification and brand recognition are not conclusive authentication of an item. Garmentz does not operate a human-review service or a verified-authentication service. See Disclaimers.

10. Valuations and Market Estimates

Values shown by the Service are estimates based on market evidence available at the time. An estimate may change when new market evidence arrives, when you add photos, or when you correct item details.

Estimates are not a guarantee of any sale price. Garmentz does not promise that a buyer, a marketplace, or liquidity will exist for any item.

Garmentz estimates are not certified appraisals. Do not use them for insurance, tax, lending, litigation, or estate purposes.

11. Marketplace and Third-Party Information

The Service may show listings, sold prices, and other references from third-party marketplaces, including eBay. Garmentz does not own or operate these marketplaces and is not responsible for their content, accuracy, availability, or terms.

Marketplace names and logos belong to their respective owners. A reference to a marketplace does not mean that marketplace endorses Garmentz or any estimate.

12. Accuracy and Availability

We work to keep the Service accurate and available, but we do not promise uninterrupted or error-free operation. Features may change over time, and some features may be unavailable from time to time.

13. User Corrections and Feedback

You can review item details and submit corrections when identification or attributes look wrong. Corrections help the Service produce a better result for that item.

14. Acceptable Use

Use the Service only for its intended purpose: identifying and valuing fashion items you have the right to photograph. Comply with applicable law when you use the Service.

15. Prohibited Conduct

You may not misuse the Service, interfere with its operation, or probe, scan, or test its systems or another user's data.

You may not scrape the Service, bulk-collect its outputs, or access it by automated means in a way that degrades the Service.

You may not upload unlawful content, content you have no right to use, or content that misrepresents an item.

You may not present Garmentz estimates as certified appraisals, or use the Service to deceive buyers or sellers.

16. Intellectual Property

Garmentz and its licensors own the Service, including its design, software, brand elements, and the text and visual presentation of results. These Terms give you a limited, non-exclusive, non-transferable right to use the Service for personal, non-commercial purposes.

Share cards are generated on your device from your own content. You may share them as you choose.

17. Third-Party Services and Links

The Service relies on third-party providers for authentication, hosting, AI processing, market evidence, and error monitoring, as described in the Privacy Policy. Links to third-party sites are provided for convenience, and Garmentz is not responsible for them.

18. Account Suspension and Termination

We may suspend or terminate access to the Service for accounts that violate these Terms, create risk for other users, or where required by law.

You may stop using the Service at any time. Deleting your account is described in the next section.

19. Account Deletion

You can delete your account in the app under Settings. Account deletion deletes your saved data and your sign-in access to the Service.

Some records may be retained only where required for security, fraud prevention, or legal obligations, as described in the Privacy Policy.

20. Service Changes and Availability

Garmentz may add, change, suspend, or discontinue features as the Service develops. Provider availability and marketplace information may vary by platform, region, and time.

We do not guarantee that every feature or third-party source will always be available, but changes do not limit rights that cannot be limited under applicable law.

21. Disclaimers

The Service is provided "as is" and "as available." To the extent permitted by law, Garmentz disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Identification, condition analysis, and valuations are automated estimates. Identification and brand recognition are not conclusive authentication of an item. Garmentz does not warrant the accuracy, completeness, or usefulness of any result.

22. Limitation of Liability

To the extent permitted by law, Garmentz is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost goodwill, arising from or related to your use of the Service.

Nothing in these Terms limits liability that cannot be limited by law, or excludes rights you have as a consumer under applicable law.

23. Governing Law and Disputes

These Terms do not select a governing jurisdiction, require arbitration, or waive class-action rights. If a concern arises, you may first contact legal@garmentz.app so we can try to address it informally.

Any dispute is subject to the laws, courts, procedures, and consumer protections that apply without a contractual choice by Garmentz.

24. Changes to These Terms

We may update these Terms from time to time. When we make a material change, we will notify you in the app and ask you to review and accept the updated Terms before continuing to use the Service. Editorial or clarifying edits that do not change your rights may take effect without separate acceptance.

The current version and its effective date are always available in the app under Settings, Legal, and at garmentz.app/terms.

25. Electronic Communications

By using the Service, you consent to receive communications from Garmentz electronically, including notices delivered in the app or to the email address associated with your sign-in provider. Electronic notices satisfy any legal requirement that a communication be in writing.
